What is Retaliation and Whistleblowing?

Workplace retaliation or whistleblowing concerns the adverse actions taken against employees who report illegal or unethical activities within their organization. Retaliation is prohibited under various federal and state laws, encompassing actions such as demotion, termination, harassment, or any form of mistreatment directed at the whistleblower. This type of misconduct not only impacts the targeted individual but can also foster a toxic work environment, diminishing morale and hindering overall productivity.

Examples of potential workplace retaliation or whistleblowing scenarios include:

Excluding candidates with common protected characteristics from the recruitment process.
Promoting a less qualified employee who hasn't reported wrongdoing over a more experienced whistleblower.
Disparities in salaries for equally qualified employees occupying the same position based on their whistleblowing activities.
Targeting older workers for layoffs as a response to their reporting of unethical behavior.
Terminating an employee who takes action against wrongdoing, such as reporting it during maternity leave.
Harassing an individual on the job due to their act of whistleblowing based on gender, religion, or other protected characteristics.
Providing a negative performance review in retaliation for an employee taking disability leave.
